[Bug] Swiping up on the d-pad does nothing

Steps to reproduce:
Load game with d-pad use (I'm playing pokemon diamond on a nexus 7)
Press somewhere on the d-pad, notice that swiping finger left, right or down changes d-pad to that direction.
Now try to swipe up while still holding finger on screen.

Expectation:
D-pad should be pressed up.

Reality:
Nothing happens. ( )

That didn't happen on any of the devices i've seen. Can anyone else reproduce that?
If you can, please let me know which phone/tablet you have.

I should have tried some more, it seems like the bug only happens in the view mode where there are two stacked windows in portrait mode.

sliding doesn't work at all on pokemon mystery dungeon (nexus 7 2012) but does on other games
