Some games require you to hold the Nintendo DS vertically (like a book) e.g. Crosswords DS, Brain training, Puzzle League DS. This means the screens are left and right.
However the on screen controls and gamepad controls are still orientated for a DS with top and bottom screens. So pressing up means the same as moving left.
I doubt you can read each game to identify it so it would need to be a per game setting when you change the screen layout.

The controls on a real DS also work that way if you hold it like a book, don't they?

No, if I open Puzzle League DS on my DS and play the game like a book then "down" is the same as pressing "left" on a normal DS game.
